The remote maintenance by Sensor-Technik Wiedemann GmbH is performed by means of the certified remote maintenance software “Teamviewer”. This software meets the current safety standards mandatory for remote maintenance. The product Teamviewer is one of the market leaders in this field, and represents maximum quality. Remote maintenance by Sensor-Technik Wiedemann GmbH requires a functioning Internet access to the client’s/business partner’s computer as well as a telephone accessible on site. In addition to the actual “issue”, the quality and the speed of the client’s/business partner’s Internet connection (e.g. DSL) is decisive for the speed and duration of the remote maintenance.
Definition of terms
The company or person utilizing Sensor-Technik Wiedemann GmbH’s remote maintenance services shall hereinafter be referred to as the client/business partner.
Sensor-Technik Wiedemann GmbH performs remote maintenance focusing on maximum accuracy and availability. Sensor-Technik Wiedemann GmbH shall only be held liable for damages occurred if the company can be blamed for intent or gross negligence. In case of minor negligence, Sensor-Technik Wiedemann GmbH shall only be held liable if essential contractual obligations (cardinal duties) have been breached.
Sensor-Technik Wiedemann GmbH’s client/business partner hereby explicitly acknowledges that Sensor-Technik Wiedemann GmbH shall not assume any liability for the availability of external Internet services or lines which are beyond Sensor-Technik Wiedemann GmbH’s sphere of influence. In particular, Sensor-Technik Wiedemann GmbH cannot be held responsible for the failure or overload of global communication networks.
Loss of data
The client/business partner is themselves responsible for the backup of databases. Liability for the loss of data shall be excluded unless the loss was caused due to gross negligence or intent on behalf of Sensor-Technik Wiedemann GmbH. Any damage claims are limited to the expenses required for restoring the data on the basis of correct data backup.
Limitation of liability
Sensor-Technik Wiedemann GmbH’s liability shall be limited to damages, the occurrence of which could be reasonably expected according to the circumstances when starting the remote maintenance and accepting these clauses. Any client damage claims for loss of profit shall be excluded. The same applies for consequential damages caused by defects and indirect damages as well as for damages which can be attributed to the client’s/business partner’s domain and sphere of risk.
Validity of the General Business Terms and Conditions
Should the abovementioned regulations prove incompletely clarified, Sensor-Technik Wiedemann GmbH’s General Business Terms and Conditions shall apply.
There shall be no additional expenses for the client/business partner except for the costs for establishing an Internet connection.
